Terms and Conditions

1. Identification data

Cold Tech Servicii S.R.L., headquartered at Str. I.L. Caragiale nr. 20, București, Sector 2, registered with the Trade Registry under no. J40/1323/2005, having C.U.I. RO17157841 (hereinafter referred to as “Coldtech” or the “Seller”), operates the online store coldtech-refrigeration.com.

2. Subject matter of the contract

This document governs the terms and conditions for the sale of products marketed through the website, namely refrigeration and air-conditioning equipment, components, and related installation/service services.

3. Order and conclusion of the contract

An order placed through the website constitutes a purchase offer from the Customer. The contract is deemed concluded at the moment Coldtech confirms the order (by email or telephone). Coldtech reserves the right to refuse an order in the event of product unavailability or obvious price/description errors.

4. Prices and payment

Displayed prices are expressed in RON (lei) and include VAT, in accordance with applicable legislation. Accepted payment methods are shown during the checkout process. Any displayed price reduction complies with the legal rule requiring reference to the lowest price applied during the 30 days preceding the reduction.

5. Delivery

Delivery times are estimates and are communicated at the time the order is confirmed. Coldtech is not liable for delays caused by the carrier or by cases of force majeure.

6. Right of withdrawal

In accordance with Government Emergency Ordinance no. 34/2014 (Ordonanța de Urgență a Guvernului nr. 34/2014), the individual Customer has the right to withdraw from the contract, without penalties and without giving any reason, within 14 calendar days of receiving the product. To exercise this right, the Customer may use the withdrawal form/button available on the website or send a written request to the contact details above. The costs of returning the product are borne by the Customer, unless Coldtech has agreed to bear them. The right of withdrawal does not apply to products customized/manufactured according to the Customer’s specifications, or to equipment that has been installed/commissioned at the Customer’s request, in accordance with the exceptions provided by law.

7. Warranty

The products sold benefit from the 2-year legal conformity warranty, in accordance with Law no. 449/2003 (Legea nr. 449/2003) and Government Ordinance no. 21/1992 (Ordonanța Guvernului nr. 21/1992), as well as, where applicable, the manufacturer’s commercial warranty stated on each product’s page.

8. Liability

Coldtech makes reasonable efforts to ensure that the published information (descriptions, prices, availability) is accurate, but cannot be held liable for obvious technical errors or errors beyond its control.

9. Dispute resolution

Any disagreements shall be resolved amicably. If this is not possible, the Customer may contact the National Authority for Consumer Protection (Autoritatea Națională pentru Protecția Consumatorilor, ANPC) or resort to Alternative Dispute Resolution (Soluționarea Alternativă a Litigiilor, SAL), in accordance with the information available at anpc.ro, or to the competent courts of law.

10. Final provisions

These Terms and Conditions may be updated periodically; the applicable version is the one published on the website at the time the order is placed.
